Rewrite part of a judgment on migration, law and policy
Written piece of work in the form of part of a judgment which seeks to provide an alternate perspective of a prominent decision in the area of migration law and policy (word limit: 2,500 words).
Choose ONE of the following cases for your coursework:
- v. THE UNITED KINGDOM (Application no. 26565/05)
OR
EM (Lebanon) v Secretary of State for the Home Department [2008] UKHL 64
Marking Criteria
The following criteria will be used in evaluating this assessment:
Subject knowledge and understanding. The ability to:
Identify the appropriate subject area and legislation.
Grasp the key legal issues relevant to the case chosen.
Be aware of supporting case law and documents.
Appreciate what is relevant material and what is not.
Explain the facts, point(s) of law, reasoning and decision for the outcome.
Analysis and evaluation. The ability to:
Work out what is important in deciding the outcome of a case, and what is unimportant.
Apply your knowledge to the facts of the case chosen.
Bring together, explain and apply relevant information and materials from a variety of sources.
Provide strong legal reasoning for your decision/outcome.
Provide evaluation of the decision/outcome.
Communication and Literacy. The ability to:
Use language, tone and terminology appropriate to the assignment, thereby demonstrating understanding of the difference in style and tone between an essay and a judgment.
Present information or argument clearly, concisely and comprehensively.
Apply the law clearly, concisely and comprehensively.
Understand and use legal terminology correctly.
Use correct grammar, punctuation and spelling.
Observe the word count.
Research and Organisation. The ability to:
Adopt a logical and structured approach to:
(a) the information gathering process, and
(b) the use of information compiled as a result of this process.
Identify relevant primary sources and other supporting documentation relevant to the topic and chosen case.
Apply these sources and authorities appropriately to the topic area.
Underpin reasoning by reference to appropriate authorities.

Formative feedback and support will be provided through the coursework prearation lecture, and during coursework preparation wokrshops in January, and drop-in sessions in early March.
