Article 38(1) of the Statute of the International Court of Justice (ICJ) is generally said to provide a list of sources of international law. However, some have argued that Article 38(1) does not provide an exhaustive list of sources of international law. For instance, Dixon notes that Article 38 “does not even provide a complete list of the matters which the Court in fact considers when considering the rights and duties of states.” (Dixon, International Law, 7th Ed. OUP 2013, p25).
Critically examine the sources of international law contained in Article 38(1) of the Statute of the International Court of Justice and critically assess the question of whether or not this list of sources is exhaustive.
