Case 2: Ethics Dilemma: A Slanted Wage Proposal

In Chapter 2, we learned that management is obligated to engage in good faith bargaining with unions over terms of employment. Setting wage and salary levels is a mandatory subject of bargaining. Johnson Auto Parts is preparing for its negotiations with the union. Mandy Mattson, Director of Labor Relations, asked Roberta Robinson, lead compensation analyst, for a market wage analysis to bring to the bargaining table. Roberta prepared the following material to discuss with Mandy. The report shows the current wage rates and proposed rates based on the market mean and median.

Roberta explained the methodology for surveying the market rates and calculating the market mean and median for each job. Mandy asked why Roberta proposed two rates rather than one. Roberta indicated that she wanted to provide a fuller picture of the market rates and discussed that the mean is less than the median when there are only a few outliers. In this case, the outliers are substantially lower wage rates than the majority reported in the survey. She went on to tell Mandy that she recommends sharing all the information with the union negotiators and to demonstrate good faith by explaining the reasoning for these differences. Mandy abruptly dismissed Roberta’s recommendation, saying that full information will likely lead to higher wage costs. Presenting the mean rates exclusively will keep labor costs down and that will make the shareholders happy. Roberta urged Mandy to reconsider this approach after a further inspection of the data revealed that some companies were unlawfully paying employees less than the lawful state minimum wage rate. The inappropriately low wage rates resulted in lower means than would otherwise be the case.

Your normal staffing is to have two RNs and one LVN on duty Monday to Thursday and one LVN and three RNs on duty during the weekend.

It has become apparent that one of the LVNs, Maggie, resents the recently imposed limitations of LVN duties because she has had 10 years of experience in nursing, including a tour of duty as a medic in the first Gulf War. The emergency department physicians admire her and are always asking her to assist them with any minor wound repair. Occasionally, she has exceeded her job description as an LVN in the hospital, although she has done nothing illegal of which you are aware. You have given her satisfactory performance evaluations in the past, even though everyone is aware that she sometimes pretends to be a “junior physician.” You also suspect that the physicians sometimes allow her to perform duties outside her licensure, but you have not investigated this or seen it yourself.

As a charge nurse, one of the responsibilities is to ensure conditions for patient care that are courteous, safe, and compassionate for the personnel, patients, and visitors. As the charge nurse in this scenario, it would be my responsibility to inform my superiors of what happened. While considering the possible legal consequences, they could both lose their licenses, and since I am aware of the issue, if I do nothing, my license will be suspended as well. Maggie was authorized by the doctor to conduct an activity that is outside her qualifications as a license vocational nurse. Therefore, the physician is the one who is ultimately liable for what happened. Even if Maggie performs a great job, if something goes wrong during the procedure her actions would be considered medical malpractice. She cannot suture a wound with her current credentials and should refuse to do such procedures. A model for a healthy work environment consisting of six requirements was created by the American Association of Critical-Care Nurses. A positive work atmosphere can result in more engaged nurses, less burnout, less absenteeism, and improved patient’s care.

What have you learned through the rough seasons/failures of life?

The rough seasons/failures of life have taught me the meaning of conviction, joy, and empathy to my fellow neighbor, both believer and non-believer. Whether it be the passing of relatives, financial distress, or relationship headaches, the perseverance would not be possible without the foundational covenant relationship that Christians have with the Lord and Savior Jesus Christ. The rough seasons/failures of life I have learned create some of the greatest opportunities to share the gospel as we are all loved and meant to be saved if we would simply accept and believe in Christ, all will be well. As I continue to overcome the rough seasons/failures in life, I still thank God for putting me through these situations as it only creates a more empowered servant leader.

What is the difference between a man-centered approach to servant leadership and a God-centered one?

The servant leadership approach leadership management style for an organization can be broken into either a man-centered approach or a God-centered approach with similarities but sustaining a major key difference where a God-centered one servant leadership approach remains Christ-centered which embraces the covenantal relationship Christians have with God versus simply employee empowerment. A God-centered approach displays a style of service to employees that shows the meaningfulness of each induvial employee and the contributions each person has made within the organization and stemming from scripture. An example of a God-centered approach exemplified by instruction found in scripture includes what Christ said in Mathew 22:37-39 which reads “37 And he said to him, “You shall love the Lord your God with all your heart and with all your soul and with all your mind. 38 This is the great and first commandment. 39 And a second is like it: You shall love your neighbor as yourself.” (ESV., 2022). A God-centered approach also utilizes the trait of healing, which takes place as a manager recognizes when an employee empty and is needed to be filled with wholeheartedness and support (Blanchard & Broadwell., 2018). While man-centered servant leadership can still foster positive benefits to the company utilizing it to plant seeds serving other people, the God-centered leadership approach is foremost about following Christ and by doing so will result in the ultimate service to your neighbor and employees.

What are some of the challenges of practically practicing servant leadership?

The leadership style selected by the decisionmakers of a company will not go without facing its adversities, including that of the challenges faced when seeking to practice and implement servant leadership within an organization. A challenge faced when practically practicing servant leadership within a company includes the concern of organizational performance, as well as company direction and production concerns as time is scarce (Crowther., 2018). This concern furthers by struggling with the managerial discernment of choosing what and how to manage the employees of the organization without distorting the efficiency and effectiveness of the business and its performance in the marketplace. The practicality of servant leadership is true and will create a flourishing environment for the organization that chooses to implement a servant leadership style that embraces employee empowerment and progression across the firm.

How does a biblical, covenantal perspective inform our understanding of servant leadership?

A biblical, covenantal perspective aids researchers in the understanding of servant leadership and its application by management within an organizational business setting. A biblical, covenantal perspective informs the understanding of servant leadership through foundationally deriving its service leadership pillars from the covenant that God has with his people on earth which includes a daily, spiritually active relationship. This perspective informs the understanding of servant leadership through the relationship aspects Christians have with God that includes collaborative accountability, open-communication, as well as employee empowerment just as Christ empowers his people. As the covenant made through Christ’s sacrifice on the cross provided his people the ultimate service, the application in the business setting follows in the same footsteps that follows as loving, caring, and serving your neighbor (or clients/consumers) as you would want to be treated.

Humility is Valuable in All Seasons

Humility is a valuable cornerstone in the ebbs and flows of life, as it is an important aspect of servitude and self-awareness for leaders (Crowther, 2018).  It is effortless for individuals to relish in success, even to the point of arrogance.  Failures however, especially after coming from a position of accomplishment, or perhaps, encountering a series of rough circumstances can remind a person quickly of their mortality and need for external support. Tangible signs of success like wealth or titles are finite, but humbleness can be exercised in both good and less favorable seasons infinitely.  Humbleness keeps a person grounded, connected, resilient, and in faith. This lesson can also been seen biblically, in the instances of Job (King James Bible, 2022).

Servant Leadership, Man-Centered versus Biblical Philosophies

            Servant leadership is altruistic in nature and does align with Christian values of servitude, however, where the biblical variant branches off is in its God-centered values at its core. Biblically, when one is serving the Lord, in turn, one is loving their neighbor by following God’s will (Babyak, 2018).  Contemporary servant leadership from the man-centered perspective places the interests of others first such as the community, customers, or followers above those deemed as leaders. Although the man-centered theory is still virtuous in nature, the greater good of humanity is the focus (Crowther, 2018). From a biblical perspective, it is important that leaders root their vision in God’s purpose and authority (Babyak, 2018).

Challenges of Practicing Servant Leadership

            Liao et al. (2021) denoted that Servant leadership research oftentimes focuses on the positive outcomes of followers and organizations, while foregoing the dynamics of the effects on servant leader behaviors.  In the study conducted, the researchers found that leaders can become depleted from exercising these actions, as daily leader performance are fluid. For example, agreeableness, communication, and mindfulness may vary.  In all, it is shown that higher levels of experience, self-efficacy, moral self-concept are crucial to avoiding servant leader burnout. To decrease the likelihood of burnout for leaders, followers can be reminded to express gratitude, leaders can take breaks, and lastly, training can be implemented to support areas where certain skills are underdeveloped (Liao et al, 2021).

The Biblical Covenant and Servant Leadership               

The covenant represents the mutual agreement that leaders and followers have to uphold within in their respectful positions.  Leaders are trusted in their duties to provide purpose, direction, and implement operations toward visions that better the larger community (Blanchard and Broadwell, 2018).  Followers also have a commitment to subscribe to the shared values placed, responsibilities, and regulatory guidelines enacted to make to organization effectively run. In Christianity, there is submission to God’s will in each role. Ultimately, God is the one that everyone is following (Babyak, 2018).

Scenario 1: Business Competition

BRG of Georgia and BARMAX, located in Illinois are the nation’s two largest providers of bar review materials and lectures that are designed to help students study and pass the bar exam for their state.

BARMAX began offering Georgia bar review course on a limited basis in 2006 and was in direct, and often intense, competition with BRG from 2007 to 2009 when the companies were the two main providers of bar review courses in Georgia. In early 2010, they entered into an agreement that gave BRG an exclusive license to market BARMAX materials in and to use its trade name Bar/Bri. The parties agreed that BARMAX would not compete with BRG in Georgia and that BRG would not compete with BARMAX outside of Georgia. Under the agreement, BARMAX received $100 per student enrolled by BRG and 40 percent of all revenues over $350. Immediately after the 2010 agreement, the price of BRG’s course was increased from $150 to more than $400.

Brian Day is the vice president of new technology development at Future Electronics in Southaven Mississippi. One year ago, he filed an application with the Federal Communications Commission to obtain approval for a new device using satellite technology. Brown worked as the director for licensing approval of new products at the FCC. Two weeks later, Brown wrote Day a letter on FCC letterhead stating, “It was nice to see your name cross my desk on your company’s application for approval of the new satellite device. I’d really like to see you again. Why don’t you come visit me in Washington this weekend?”

Day considered requesting that the petition be referred to another director at the FCC. However, he is concerned that the transfer would delay the approval process for at least a year. Day’s chief engineer advised that a key competitor plans to introduce a similar device on the market in three months.

Scenario 3: International Law

Reliable Time Inc. imported a shipment of watches into the United States. The watches contained the mark “Lauren” which is a registered trademark owned by Ralph Lauren. U.S. U.S. Customs and Border Protection (CBP) seized the watches pursuant to the Tariff Act, which authorizes seizure of any “merchandise bearing a counterfeit mark.” Ralph Lauren did not make or sell watches at the time of the seizure. Reliable argued that because Ralph Lauren did not make watches at the time of the seizure, the watches it imported were not counterfeit, and the civil penalty imposed by CBP was unlawful. The government argued that the mark was counterfeit and that the Tariff Act does not require the owner of the registered mark to make the same type of goods as those bearing the offending mark.

Scenario 1: Jurisdiction and Choice of Law.

Three friends from Florida were going cross-country skiing in Michigan. Shirley, the first skier came to a stop sign on the trail, waved at her companions and stopped. Jackie, the second to approach, was going too fast to stop, veered to the left and tripped over a log. Jane, the third skier was going so fast she clipped Shirley’s skis, fell over Jackie and slammed into a tree. Jane broke bones in her right arm and leg, which required surgery to repair the injuries. Jane filed a lawsuit against Shirley and Jackie in a trial court in Florida, claiming that each of her friends was liable to her for their negligent skiing. A Michigan statute specifically stated that snow skiers assumed the risks associated with skiing. Florida law did not contain an assumption of the risk rule regarding skiing. The two defendants made a motion for summary judgment.

Scenario 2: Constitution

Paul Mitchell, a student at Raleigh Egypt Middle School learned he received a “D” in his history class, which meant he would have to attend summer school. Mitchell posted on Facebook that his history teacher and the principal should be shot. Mitchell also posted a cartoon that showed the teacher’s head on a body that had been mutilated. Mitchell’s mother instructed her son to remove the post, but he refused. The principal suspended Mitchell for the last month of school and contacted the police.

Determine whether Mitchell’s statement and resulting actions by the school violate the First Amendment. Provide support your answer.

Scenario 3: Minimum Contacts

All Hands Gloves, a company in Minnesota, sold three shipping containers of latex gloves to MedSpa, a company based in Tennessee. When MedSpa failed to pay the $42,120 owed on the gloves, All Hands filed suit in a Minnesota court and obtained a judgment against MedSpa. MedSpa argued that it did not have minimum contacts with Minnesota because it was incorporated in Tennessee. Therefore, the Minnesota judgment based on personal jurisdiction was invalid.

Was this argument alone sufficient to prevent the Minnesota judgment from being collected against MedSpa? Make arguments for both parties, select a winner and support your answer.

Scenario 4: Alternative Dispute Resolution1

Frances, a 50-year-old woman employed by Accent Manufacturing, was presented with a mandatory arbitration agreement to sign three years after starting work. When Frances was terminated, she filed a claim with the EEOC under the Age Discrimination Employment Act. Accent Manufacturing filed to dismiss because of the arbitration agreement.
