  1. TO DO: Time to get creative. Once you have read chapter 5 you are to create a diary about the events you witnessed leading up to the American Revolution. You should have “5” events on the diary.

September 21, 1939: I’m not sure what is going on right now. We are being moved from our small towns into urban centers. I’m very scared and don’t know what is coming next.

September 30, 1939: We’ve settled into our urban centers. We are working with the Polish to fight against the Germans. They are destroying us and we are left decimated. I’m hopeful that things could get better.

November 10, 1939: Things are not getting better. The welfare organizations are no longer giving us aid. We were given armbands to wear and curfews. We were banned from streetcars, restaurants, public parks, and promenades. We also cannot get treated by doctors or dentists. Things are not looking good.

I’m not too sure as to what is going on and I’m starting to lose track of the days. We are being shot and killed and it is impossible to describe the scenes. Criminal Justice Question

You are in Johnson County in the deep South. The Sheriff, Jim Jones has had a murder, and the FBI has come in to claim jurisdiction. It appears that this suspected perpetrator is a serial killer who has been crossing state lines. Sheriff Jones has a force of all Caucasian officers. He is also known for his propensity to denigrate minorities. The FBI force consists of Caucasian officers, Asian-American officers and African-American officers. The lead investigator is of Asian descent. Sheriff Jones has to work hand-in-hand with this lead investigator. He has shown that he is not happy about the situation.

In your examinations this week, focus on the power of jurisdiction and its significance as part of the criminal justice system. Who creates jurisdiction, and why is it so significant? Similarly, a sound understanding of the legal requirement that the prosecution must prove every element of a statute beyond a reasonable doubt is required for all criminal justice professionals. This discussion requires you to examine reasonable doubt instructions for juries from three states and choose which one is best; remember to justify your responses with reliable sources.

Case discussion

Police officers believed that Deft had assaulted Bart because Bart failed to pay Deft for cocaine Deft sold to Bart. The others obtained a valid warrant for the arrest of Deft on an assault charge. They went to Deft’s apartment and arrested Deft at the front door when he responded to their knock. The officers then walked through the apartment and, in a rear bedroom, saw drug paraphernalia which they left in place.

A police officer advised Deft of his Miranda rights. Deft immediately stated: “I do not want to talk to you.” Deft was booked and placed in a cell with Snitch, an inmate who was known by the jailers to be an informant. Snitch asked Deft why he had been arrested and engaged Deft in a conversation about drug sales during which Deft made statements incriminating himself concerning drug trafficking. Snitch promptly related Deft’s statements to jail personnel.

Police then obtained a warrant authorizing a search of Deft’s apartment for cocaine and drug paraphernalia. The affidavit in support of the warrant recited that Deft had sold cocaine to Bart. The affidavit also recited that a police officer had seen drug paraphernalia in Deft’s apartment. The affidavit did not disclose Deft’s statements to Snitch or the circumstances in which police observed the drug paraphernalia. Officers who executed the search warrant seized the drug paraphernalia and cocaine which they also found in the apartment.

Deft has been charged with possession of cocaine and drug paraphernalia under applicable state laws.

Deft has moved to exclude from evidence his statements to Snitch. Deft claims his statements were involuntary, were elicited after he invoked his Miranda rights, and were obtained in the absence of counsel. He argues that admission of the evidence would violate his rights under the Fifth and Sixth Amendments to the United States Constitution.
