DISCUSSION QUESTION

Construct a paper that includes the following items. Be sure each item listed below has a section header to identify it within your paper.*

Introduction
• Key considerations relative to the Fourth Amendment and the investigation of cybercrime
• Tools and techniques related to the investigation of cybercrime
• general investigative steps necessary to conduct this specific investigation
• An explanation of why those investigative steps might be useful in this cybercrime investigation

Conclusion

A general understanding of the Fourth Amendment relative to cybercrime and some general investigative steps are expected in this paper. You are not expected to have expert-level knowledge of cybercrime investigations. As a tip, studying past case summaries on similar topics might provide some insight into considerations related to cybercrime investigations and identity theft.

Fourth Amendment:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The court could choose either a preliminary hearing or a grand jury proceeding to establish probable cause for the felony charges in this case. Compare and contrast the two procedures.

Analysis and Application: Legal Rights Afforded to the Accused

The following case study presents issues related to the legal rights afforded the accused and the reasons those rights are provided to all individuals under our system of criminal justice.

Case Study:
John Doe is an individual who left his country in an effort to make a better life. However, he does not have legal status in America and was recently arrested for shoplifting merchandise, which was valued over $1,000. At the time of his arrest, John voluntarily began to make incriminating statements to the arresting officers. At the police station, detectives conducted an interrogation of John asking him about the theft. John Doe has had no prior arrests, is 35 years old, and most of John Doe’s family still resides in his home country. Due to the amount of money involved, the crime is deemed a felony and John was arrested and placed in county jail, however, he has no money for bail.

Discuss the following questions, explaining your answers in detail by analyzing the facts presented and other factors you consider relevant; defining and explaining key legal terms and principles; and citing legal authority (your text and other legal authority) to support your conclusions in a 2-3 page paper (excluding the title page and reference page).

1. Since John was in custody, what are the procedural steps the police were required to take once John began to incriminate himself?

2. What procedural steps must the officers perform following John’s arrest and interview at the police station?

3. The court could choose either a preliminary hearing or a grand jury proceeding to establish probable cause for the felony charges in this case. Compare and contrast the two procedures.

4. Identify what issues the judge would take into consideration when setting bond for John.

5. Explain what an arraignment is and what occurs during an arraignment.

Research the case law and statutory law behind self-defense and the use of deadly force. What does the case law reveal that an average citizen can use in terms of self-defense and deadly force?

Research Paper

Research the case law and statutory law behind self-defense and the use of deadly force. What does the case law reveal that an average citizen can use in terms of self-defense and deadly force? How is that different than what a law enforcement officer can do? Provide a detailed analysis of the case law in which the courts have grappled with these issues. Focus primarily on the Supreme Court cases on this issue.

Explain whether your selected topic is (or should be) a public policy-related matter, and why.

Use effective, well-designed search strategies and tools to efficiently and creatively refine searches, on the fly as needed

Apply multiple criteria to assess relevance, currency, authority, accuracy, purpose, audience and ideological perspectives related to your topic.

Look for statistical evidence that either supports or detracts from the criminal law-related challenges that you address, and explain its relevance and value to your selected topic.

Clearly and effectively communicate, organize, and synthesize complex and often contradictory information to advance graduate level scholarly knowledge about your selected topic.

Quote, paraphrase, and cite information correctly and consistently, always using information in ways that are true to the original context.

Identify and select an issue that could potentially polarize a specific risk group. Develop and explore the issue and why it can be a polarizing or divisive issue. Discuss how certain risk populations can become radicalized, causing them to justify the use of violence to elevate their political, religious, economic, or extremist position.

 Controversial issue

In this assignment, you will choose a present-day controversial issue, such as immigration reform, government encroachment on privacy rights, anti-capitalism views, and discuss how issues like these might result in terrorism from some groups. In 2–3 pages, address the following:

Identify and select an issue that could potentially polarize a specific risk group.
Develop and explore the issue and why it can be a polarizing or divisive issue. Discuss how certain risk populations can become radicalized, causing them to justify the use of violence to elevate their political, religious, economic, or extremist position.
Place yourself in the role of a policy maker. What kind of legislation could you propose to address the social, political, or economic conditions that you described above? How will your proposed solutions improve conditions for the specific risk group that you identified?
Discuss constitutional issues regarding civil rights in policymaking.
Be sure to reference all sources using APA style.

Discuss how prison labor; prison profits; privatization; prison health care, officer conduct; women in prison; and prisoner struggles and rebellions developed the correctional treatment industrial complex.

DISCUSSION ESSAY

Read scheduled material before each assigned class. It is important to note that lecture notes and discussion board topics will not necessarily cover all the information in the assigned reading. This, however, does not reduce your responsibility for making sure that you completely read all assigned reading materials. Students are either encouraged to ask question via email to professor, Blackboard, or during the designated office hours to address any misunderstanding of the information presented in class or assigned reading materials.

Student Course Learning Objectives:

Upon successful completion of this course, the student will be able to:

Assess how the U.S. society approach to solving crime has come to rely upon the use of imprisonment

Assess how race and class bias is affecting the crime control model of the criminal justice system

Analyze how the American penal system developed into an imprisonment binge.

Describe privatization in correctional services.

Discuss how prison labor; prison profits; privatization; prison health care, officer conduct; women in prison; and prisoner struggles and rebellions developed the correctional treatment industrial complex.

Assess the effectiveness of 21st century programs and policies that impact the future of the prison industrial complex.

Describe the criminal justice policy or program to be evaluated, including its goals, objectives, strategies, and activities. Describe the importance of the proposed evaluation for this policy or program. Identify the questions that the evaluation should answer.

Summative assessment

What does each part of the evaluation process—planning, design, and implementation—look like in the example you chose?

Part of building a culture of continuous improvement is planning, designing, and implementing effective evaluations that will provide meaningful answers. Another aspect is using the findings of the evaluation to revise programs or design new policies that will correct problems or fill in any identified gaps. In this summative assessment, you plan and design a criminal justice policy or program evaluation, including how the evaluation would be implemented; and you present proposed changes to the policy or program based on the hypothetical evaluation results.

Research and select a criminal justice policy or program for evaluation.

Complete Parts 1 and 2 below.

Part 1: Evaluation of a Criminal Justice Policy or Program

  • Write an 875- to 1,050-word paper describing the plan, design, and implementation of your evaluation. Address the following in your paper:
  • Describe the criminal justice policy or program to be evaluated, including its goals, objectives, strategies, and activities.
  • Describe the importance of the proposed evaluation for this policy or program.
  • Identify the questions that the evaluation should answer.

Why do you think domestic terrorists exist in society? Explain. Do you think various triggers drive them to extremism, or are they slowly conditioned throughout their lives? Explain.

TERRORISM

Domestic terrorism is noted for its lack of foreign involvement. There is a long history of domestic terrorism within the United States. Domestic terrorist organizations have arisen in a broad political context. For example, the emergence of hate crimes has blurred the characteristics that separate domestic terrorism and hate crimes. It should be recognized that there are instances when hate crimes could also be categorized as domestic terrorism.

Address the following:

Why do you think domestic terrorists exist in society? Explain.
Do you think various triggers drive them to extremism, or are they slowly conditioned throughout their lives? Explain.
Do children learn domestic terrorism outlooks from their parents, peers, another source, or all three?
In your own words, describe the differences and similarities between domestic terrorism and hate crimes.
