Respond to the following two scenarios:

1. A Delaware law features a new version of the scarlet letter. Anyone convicted of a sex crime (including sexual abuse of a child) is immediately issued a new driver’s license with a ”Y” stamped on the front. The meaning of the code is explained on the back of the license. If the ex-offender moves to another state and turns in the Delaware license, that state would be alerted as to the offender’s past conviction. This new law was added to the existing Megan’s law, now passed in virtually every state, that requires convicted sex offenders to register with local police and child welfare agencies so that neighbors can be notified even after the offender’s sentence has been completed. The sponsor of the new law said, ”This additional information will give police the ability to thwart some sex crimes before they occur.” Simply checking a person’s identification will alert police to a past conviction for a sex crime. Opponents argue that such a label will interface with an ex-offender’s ability to get a job, cash a check, rent an apartment, or do anything that requires picture identification. This will impede efforts of former sex offenders to live law-abiding lives. It also unfairly discriminates against sex offenders versus other kinds of ex-offenders.

Assess the moral permissibility of a scarlet letter such as that used in Delaware.

2. Michael Costin was knocked unconscious during a fight at a hockey rink and died. He had indicated that he wanted his heart donated as an organ transplant on his death, but the district attorney (DA) blocked the donation. Costin’s death at the hockey rink resulted in a criminal prosecution of the other "hockey-dad" who assaulted him. On Costin’s death, the charge against the defendant became manslaughter. The DA blocked the heart donation because she didn’t want the defendant to claim at trial that Costin died of a preexisting heart condition rather than from the fight. The result of this decision was that it may have cost a heart patient the opportunity for a life-saving transplant. Doctors claimed that preserving (and not transplanting) Costin’s heart offered little medical evidence because it was healthy—the heart would have been rejected if it was defective in any way. Several doctors believed it was clear that Costin died from head trauma and that his heart was fine. One physician declared, ”It's very, very likely that, because of this decision, someone with heart disease died.” However, a professor argued, ”there is also the interest in making sure we have all the evidence necessary so that justice is served.” The DA said that according to an EMT at the fight scene, "it was a possible heart attack [and] we didn’t want to give the defense an issue at trial to allow them to say, 'We really don't know the cause of death'’to raise doubt in the minds of jurors.

Police reaction to a perceived threat

Note: Be careful about the case you choose. Make sure you pick a case that specifically calls in to question the ethical integrity of a law enforcement officer. Shoot-don’t-shoot scenarios are not about ethics, they are about spontaneous reactions.

The killing of Philandro Castille, for example, is not about ethics, it is about a police reaction to a perceived threat. The perceived threat might be deemed unfounded and the police action might be an overreaction, but these are not ethical considerations.

Ethical considerations would be lying, creating false documents, fabricating evidence, ignoring relevant evidence, etc.

Also, cases that do not involve a “public response” are not appropriate for this assignment. The “Police Agency Reaction to Public Response and Possible Police Leadership Courses of Action to Prevent Future Violations” is a key element of the assignment that is weighted with 35 points (See the Grading Rubric). If you choose a case for which there was no public response, you will not be able to earn any of these points.

Scenario Part 1
On March 12, 2014, at approximately 2200 hours, the Sunnyville, Utah Police Department received a 911 call of an armed robbery at 201 SE 2nd Ave. Upon the police arriving on scene, Victim 1, Luke Roberts, had been shot in the head and deceased. Victim 2, Liam O’Neil, was pistol-whipped. Both victims were robbed of their cell phones and wallets at gunpoint. Liam O’Neil was able to identify both suspects and the getaway vehicle. A short distance away, police stopped the suspect vehicle with two Caucasian males that matched the description provided by Mr. O’Neil. After the two suspects were positively identified, they were arrested and brought to the police station for interviews.

Before the police interviewed the suspects, they read them their Miranda rights. Suspect 1 refused to speak to the police, invoked his Miranda rights, and stated that he wanted a lawyer. The police began asking Suspect 2 specific questions about the crime. Suspect 2 stated “I’m not sure I should talk to you,” but then hesitantly proceeded to answers questions, making several incriminating statements.

He also stated that Suspect 1, Steve Chapman, hid the gun used in the robbery in the attic of his house under the insulation. The police asked Mr. Hopkins for consent to search his residence, but he immediately remembered an episode of his favorite police show and refused to give you permission to search his house for the evidence.
As the lead detective, you have decided to secure the residence, and you proceed with a search warrant. Using fictional details of your own choice, draft an affidavit and search warrant.

Context
Most people have come to view the government institutions that compose the criminal justice system as politically, economically, and racially neutral.
However, activists and academics who either challenge and/or study social systems and networks that reproduce inequality argue that the criminal justice system has grown considerably in the last 50 years in response to social movements and economic issues of the 1960s.

Debate
Imagine you’re discussing incarceration with someone you know, and this person argues that the criminal justice system is neutral, and merely reacts to crime.
According to this person, the reason the criminal justice system is so large today is because crime increased.

Goal
Write an essay explaining how the criminal justice system grew through Law & Order politics, which was a reaction to the socio-political crises faced by elites and created by popular social movements. In other words, explain how prisons grew because they resolved a political crisis for elites; being tough on crime was politically profitable.
