Describe, explain and select an appropriate methodological approach and sampling strategy and design data collection instrument/s for a specified research project. Describe and apply principles of ethical research.

Research Design

Do an extensive research to effectively and faithfully present the current ‘thinking’ in relation to each topic. Each key point you make needs to be validated with empirical research – this is what will validate your argument and makes your work persuasive. It would be best to spend more time constructing effective sentences and paragraphs. Each sentence needs to address an assessment task directly. Go through the task description and marking criteria and follow each guideline. There will be a collaboration session in two days regarding the task. It will be a focus on how to complete this task.

The learning outcome for this task are:

1 Describe, explain and select an appropriate methodological approach and sampling strategy and design data collection instrument/s for a specified research project;

2 Describe and apply principles of ethical research;

3 Report the key elements of a written research proposal according to American Psychological Association guidelines;

4 Be cognizant of the range, complexity and value of criminological research

Course learning objectives 2.1, 2.2, 2.3, 2.4, and 2.5

Describe how judges will be chosen for each court and must discuss how judicial and attorney ethical standards will be structured and enforced.

Court system for the State of Puerto Rico

You must create a court system for the newly created state of Puerto Rico. You are to work under the assumption that Puerto Rico has just been admitted as the 51st state and build your court system from the bottom up. To be certain you understand how courts are organized in other states, you must research at least three current state court systems, within the United States, and use those systems to create Puerto Rico’s system. Do not use Puerto Rico’s current system as one of your examples. You must describe your proposal for creating Puerto Rico’s municipal courts, major trial courts, appellate courts, and the state’s highest court. Include geographic jurisdictions.

You must also describe how judges will be chosen for each court and must discuss how judicial and attorney ethical standards will be structured and enforced. You should conduct basic research on Puerto Rico (size, geography, population, existing counties or municipios, etc.) to be certain your proposed system will actually work.

Remember to provide citations when you borrow some idea or structure from another state.

The body (not including cover page, works cited/bibliography, etc.) of the paper must be 10-12 pages in length, double spaced, using Times New Roman 12-point font. A works cited page or bibliography (depending on the citation system used) must be included. Submitting too many pages will have the same result as submitting too few pages. Any images, charts, etc., used in the paper should be submitted as exhibits and are not included in the page count requirement.

Research how data are used in the criminal justice system with regard to the issue of marijuana legalization. Prepare a final Strategic Operational Plan Proposal (SOPP) based on the scenario given and the SOPP template provided.

Marijuana legalization

Research how data are used in the criminal justice system with regard to the issue of marijuana legalization. Your discussion should include the following:

The costs (time, wages, personnel allocation, logistics, and so forth) expended on processing suspected marijuana offenders through the court system.
The costs (time, wages, personnel allocation, logistics, and so forth) dedicated to the imprisonment of convicted marijuana offenders.
Investigate the crime rates in cities in which marijuana is legal. Compare that data with the crime rates in cities where marijuana remains illegal.
Include your opinion on whether or not marijuana should be legalized and decriminalized.

Prepare a final Strategic Operational Plan Proposal (SOPP) based on the scenario given and the SOPP template provided. Incorporate any useful feedback from your instructor and peers. Complete sections I thru III using research previously conducted in the first 3 phases as well as the scenario information. You must also provide the strategies you recommend for countering the identified threats (entry points in Mexico as well as possible targets for Chicago).

The special agent in charge of the multi-agency Joint Terrorism Task Force (JTTF) tentatively approved your plan and has asked you to submit an Executive Summary of 600–800 words for your SOPP for submission to the Deputy Director of the FBI, as well as an update to your SOPP with any edits or new information, as needed.

Which features of state courts do you believe should be reformed? Which are ideal in their current form?

Reforming State Courts

Because of federalism and the goal of protecting state political and legal autonomy there is no such thing as a “uniform” court structure used by the states (as will be apparent as you conduct research for your Puerto Rico papers this term). Which features of state courts do you believe should be reformed? Which are ideal in their current form?

Explain whether the government’s overriding need to fight terrorism outweighs the Sixth Amendment rights of the accused. Identify whether the Sixth Amendment applies to terrorists since the writers of the Constitution could not have envisioned mass shootings and suicide bombers.

The Secret Trial paper

In the ongoing war on terrorism, the new president has proposed expanding the jurisdiction of the Foreign Intelligence Surveillance Court (FISA). FISA is a U.S. federal court established and authorized under the Foreign Intelligence Surveillance Act of 1978 to oversee requests for surveillance warrants against foreign spies inside the United States by federal law. The new president’s proposed Secret Terrorism Trial Bill will expand the jurisdiction of the FISA to hold secret, non-public trials of accused terrorists for any planned or actual acts of terrorism on U.S. soil. The bill will also allow witnesses to testify before the FISA Court by remote video with their identities kept secret from the accused and any defense team. The stated purpose for the secrecy is to allow trials of terrorists without giving them a public platform for their radical ideology and to allow witnesses to testify without fear of reprisals from terrorist groups such as ISIS or Al-Qaeda.

Write a paper addressing the following:

Explain whether the proposed Secret Terrorism Trial Bill violates the Sixth Amendment right to a public trial,

Describe whether the proposed Secret Terrorism Trial Bill violate the Sixth Amendment right to confront the witnesses against you.

Explain whether the government’s overriding need to fight terrorism outweighs the Sixth Amendment rights of the accused.

Identify whether the Sixth Amendment applies to terrorists since the writers of the Constitution could not have envisioned mass shootings and suicide bombers.
