What is the problem being addressed? Who is affected by this problem? Why does this problem exist? Why does the problem persist? What is at stake if the problem is not solved? Who can take action? What should they do, exactly? Why would this help? What are the positive and negative aspects of your solution(s)?

Counterterrorism efforts with the U.S. Department of Homeland Security

Analyze ways to improve counterterrorism efforts with the U.S. Department of Homeland Security.

This analysis project requires you to tackle the problem by first exploring it, its causes, and its impacts. Then recommend practical solutions to solve the problem.

Here are questions to help guide your analysis:

(Note: you are not directly answering these questions in the paper. These are just to guide the content of the analysis.)

What is the problem being addressed (explain, describe, and “prove” that it exists)?

Who is affected by this problem?

Why does this problem exist (identify the root causes)?

Why does the problem persist (identify the major factors that contribute to the problem’s ongoing presence)?

What is at stake if the problem is not solved?

In forming your solution, use these questions to guide you:

Who can take action?

What should they do, exactly?

Why would this help?

What are the positive and negative aspects of your solution(s)?

PURPOSE OF THE ESSAY: To analyze the problem and provide a solution

Write about a policy for racial profiling in your own feelings and views, but ensure you back any data up with peer reviewed sources.

A policy of racial profiling by police officers to reduce and prevent crime on the streets

Feel free to write about a policy for racial profiling in your own feelings and views, but ensure you back any data up with peer reviewed sources.

The papers should have a brief introduction, appropriate transitions between topic areas, and a short conclusion. I am interested in each student’s ability to craft an organized approach to an ethical issue in criminal justice. Synthesize the literature on the subject and critically assess the ethical issue.

Substance: Each student should be able to craft a well-reasoned ethical argument. Since we will be addressing “hot” topics of current debate, emotions will run high. However, try to support your argument with more than just emotion. Where appropriate, essays should draw from course readings, lectures, and discussions particular to the subject matter.

References: Consult at least five (5) outside peer reviewed sources to complete this assignment (the course readings do not count). Consider the five-source requirement as establishing the baseline; students seeking higher grades are advised to broaden their research.

What was the most significant message you got from viewing the resource videos on the criminal justice response to victims? What are two things you believe the criminal justice system can do to be more responsive to the needs of domestic violence victims?

Domestic Violence

Review the Discussion 1 required resources before addressing these questions. Those resources are located in Module 1 under FIRST WEEK in the “Module I – Part 1 Overview and Learning Materials” folder. They are listed under the heading, REQUIRED Discussion Resources. Purpose of Discussion 1 Writing Assignment: To analyze how myths occur, increasing awareness about the types of false beliefs, explanations and definitions about domestic violence. Critically explore how myths relate to and influence the frustration by criminal justice professionals and can lead to revictimization of the victim by our system of justice. Encourages students to think about remedies to prevent revictimization, emphasizing the importance of viewing domestic violence not just as a crime but as a human rights issue.

Assignment questions (6) should be 2 to 3 pages long in paragraph form and not include the instructions/questions.

Describe some currently proposed alternative drug control strategies, and summarize how results from these could differ from the consequences and outcomes of the War on Drugs Policy.

Do you think our current education system is still encouraging first and second generation immigrant children to adopt the national civic culture, in other words assimilate? If yes, does this need to be changed? What do you think could be done differently? If not, is our current education system helping children understand and embrace their multiple identities?

There are two parts to this assignment: A question and an answer to the question below. There is further directions below as well and an example.

Below is the question you can answer:
Arvizo, Question

Assimilation refers to the process of an individual from a different culture adopting the culture in the new country to integrate into society. Though, this week’s learning materials have highlighted that assimilation for immigrants does not allow for full integration into society; rather, when “Asian and Latino immigrants assimilate, they also assimilate to the United States racial hierarchy…they assimilate by becoming people of color in a racially divided society” (Chomsky, 2007, p. 106). Furthermore, assimilation can cause conflict between cultures. For example, “some teachers used soap to wash the mouths of Mexican American students who spoke Spanish in schools in Southwestern states such as Arizona” (Banks, 2017, p. 372). Ultimately, teaching children to reject their native culture, making it impossible to meet the standards of embracing their native culture at home and rejecting their culture in school. Thus, schools are not helping first and second generation immigrant children understand their multiple identities, rather their focus is to teach children how to be successful in American society.

Do you think our current education system is still encouraging first and second generation immigrant children to adopt the national civic culture, in other words assimilate? If yes, does this need to be changed? What do you think could be done differently? If not, is our current education system helping children understand and embrace their multiple identities?

Was this a violation of Peter’s Sixth Amendment right to counsel? Fully explain your answer.

What is assistance of counsel?

For example: Two college friends, Richard and Peter are arrested by the Capital City police. They are accused of murder for setting fire to the Capital City University administration building one night and causing the death of a janitor in the fire. Both Richard and Peter were members of a student organization that claimed that the administration of the University was corrupt, and at a rally they carried signs outside the building that read “Burn it to the ground.”

Richard’s father is very rich. He hires a team of the most expensive lawyers in the country, and after an eight-day trial, Richard is acquitted by a jury. Richard’s lawyers sought and received a separate trial for him.

Peter’s parents have no money, and Peter has massive student loans and works two jobs to pay for school. He is represented by a public defender who has 120 other cases. Though the public defender does his best with limited time and resources, Peter is convicted after a three-day jury trial.

Peter is now appealing his conviction, claiming that having a public defender with 120 cases effectively denied his right to counsel.

Was this a violation of Peter’s Sixth Amendment right to counsel? Fully explain your answer. Be sure to support your answer with scholarly sources and appellate court opinions.

Determine whether Hand was entitled to Miranda warnings. Explain whether the fact that Hand was not a citizen of the United States affects his rights in relation to the Fifth Amendment right to remain silent. Identify whether Hand’s questioning was custodial.

The Right to Remain Silent paper

Read the following case scenario:

The former Sameer Shariff, a Saudi Arabian national who changed his name to “The Left Hand of God” and is known to his followers as “Hand,” is a suspected terrorist. Department of Homeland Security (DHS) agents believe that he is planning an imminent attack somewhere in Capital City. Under duress to prevent the attack, three DHS agents and three FBI agents storm into Hand’s house, burst into his bedroom, where he is in bed with a woman, and point shotguns at him. They demand to know what he is planning. No Miranda warnings are read. Hand tells them that he has hired Alex “Boom Boom” Jaxon, a known explosives expert, to plant a bomb in the Capital City Arena, with a timer to go off in three hours when the arena will be filled with over 20,000 people for a music concert.

Jaxon is known to the police and is in Central City, which is two hours away. He is arrested by Central City police and calls his lawyer in Capital City, who tells him he will meet him there and to remain silent. The lawyer then tells Central City police that they are not to question Jaxon until they arrive in Capital City and the lawyer is present.

Central City Police Officer McFadden drives Jaxon to Capital City. McFadden knows that DHS, FBI, and Capital City police are searching the arena, but McFadden is afraid they will not find the bomb in time. By the time that McFadden and Jaxon arrive in Central city, the concert hall is already full of audience members, and the show is set to begin in twenty minutes.

McFadden, who knows Jaxon’s family from previous police contacts, tells Jaxon that his mother and two brothers, who have been surveilled by the police for the last six weeks, are at the concert and will die if the bomb goes off. Jaxon leads McFadden to the bomb, which is defused. A crying Jaxon states that his purpose was to kill infidels, but he would never harm his family.

Research Fifth Amendment cases, including Miranda v. Arizona, 386 U.S. 436 (1966), which involves custodial interrogation and the right against self-incrimination.

In your paper,

Explain whether the fact that Hand was not a citizen of the United States affects his rights in relation to the Fifth Amendment right to remain silent.
Identify whether Hand’s questioning was custodial.
Explain whether McFadden’s statement abouthis family constitutes custodial interrogation.
Evaluate whether Hand’s statement can be used against him in a court of law.
Explain whether Jaxon’s statement be used against him in a court of law.
Determine whether Jaxon can testify against Hand.

What changes have been made in your chosen reform compared to the old law? What fosters the changes in law or practice?

Raise the Age

Instructions

Design a poster based on your research of the NYS criminal justice reform listed below.
“Raise the Age”

In your poster, provide information (as concisely as possible) on the following questions to the best of your ability. Your probably won’t find answers to all these questions but give it your best effort.

1. What changes have been made in your chosen reform compared to the old law? • Summarize the key changes. Don’t just copy and paste. Your poster is going to look really messy if you do that.

2. What fosters the changes in law or practice? (e.g., a specific incident? A realization of social injustice?)

3. What changes have occurred after the implementation took effect? • Are they positive changes or negative changes? (e.g., crime rates went up/down after the reform? The public is happy or not happy with the reform? – you can do a simple news search on Google – keep in mind that many news articles are reflections of emotions/opinions, but NOT scientific evidence.

4. Anything else that you think is interesting for us to know regarding your chosen reform?
