Overview:
The Case Brief assignment requires students read the In re Winship case 397 US 358Supreme Court 1970. These decisions were landmarks and ultimately led to changes in our case law. These assignments allow you to work through the case from the perspective of one of the 9 justices and form your own opinion.

Instructions:
Using the case brief template,

o Brief the In re Winship case 397 US 358 Supreme Court 1970. A link to the case has been provided in the readings and resources section of the unit.

o In the 7th step “analysis section” take the perspective of one the nine justices and explain what your decision would have been.

What is it that the organization/group would like from the police? (e.g., this may be things like protection, eradication, more training, etc..) Discuss two ways (for each of your 3 organizations/groups) that a police chief may respond favorably to these organizations/groups but still maintain success in the police management realm?

Discussion Week 1

While we all know the police serve the “community,” it is important to understand that the community is made of an enormous number of individuals, groups, and organizations. Each of these have their own beliefs when it comes to the police.

Select at least three organizations or groups from outside the police agency. Then, address the questions that follow. Remember, some groups will want to eliminate the police, others will want to give the police more latitude and power, while many have a far more neutral view, and only want the police to address their specific issues, as well as those groups that want to restrict the role of the police department.

1. What is the mission of the organization/group? Provide this and a brief description of the organization/group.

2. What is it that the organization/group would like from the police? (e.g., this may be things like protection, eradication, more training, etc..) Discuss two ways (for each of your 3 organizations/groups) that a police chief may respond favorably to these organizations/groups but still maintain success in the police management realm?

3. Discuss two challenges that a Chief may face trying to maintain relationships with community stakeholders (such as the organizations/groups you chose) in their role as a Police Chief and the duties and responsibilities that they have in that role.

Community-oriented policing

The application of a community-oriented policing (COP) program involves addressing a specific need or problem that police officials and community members have collectively identified. Such addressing of specific community problems is often referred to as problem-oriented policing (POP). The application of POP within a COP strategy is clarified by the following diagram:

One way to address the problem or need would be to apply the SARA model. The SARA model emphasizes four phases of a problem-solving process: Scanning, analysis, response, and assessment. Through the SARA model of problem solving and a COP program or project, solutions can be sought that address the community members’ quality-of-life issues, fear of crime, and crime prevention.

Address the following:

    • Scanning

  • What are 2 community problems where you live?
    • These can be vandalism, serious crimes, juvenile crime, vandalism, police misconduct, and so on.
    • Describe the 2 problems as they are specific to your community.
      • Who are the perpetrators?
      • Who is affected?
      • What is currently being done about them?
    • Explain how you think the SARA model would aid in solving these 2 problems. Be specific.

 

Considering the ideas and concepts covered this week, what crime or crimes has Maria committed? Explain your reasoning, especially with regard to actus rea, mens rea and corpus delicti. What might be some valid defenses that Maria may assert?

W2: Actus Rea and Mens Rea/Defenses

The following discussion comes from your Week 2 readings. Outside research to address these issues is required. Use the online library for additional sources of information and research. In addition, I recommend utilizing the Legal Studies Program Guide.

There are two basic elements required for any crime: actus rea and mens rea. A crime must be the result of a voluntary act and it must have the evil intent at the time of the crime. This is established by looking at the state of mind of the offender at the time of the crime.

Defenses to a crime can be justifications or excuses. A justification defense indicates that the act was criminal, but the actor was justified, while defenses of excuse indicate that the act was not a crime due to some extenuating circumstance.

Read the following scenario and and answer its questions:

Maria has been angry with Carlos for a very long time. She had threatened to kill Carlos on a couple of occasions. One day, Maria sees Carlos standing on a street corner waiting to cross the street. There are several people standing around Carlos, also waiting to cross. Maria pulls out a gun and fires at Carlos. The bullet grazes Carlos’s arm, injuring him. However, the same bullet strikes and kills Raquel, who was unknown to Maria.

1) Considering the ideas and concepts covered this week, what crime or crimes has Maria committed? Explain your reasoning, especially with regard to actus rea, mens rea and corpus delicti. What might be some valid defenses that Maria may assert?

2) Now, research the relevant statutes in your state that correspond to the crimes and defenses that you discussed in your answers to Q1. In light of what you see in your state statutes, how might your answers, including about possible defenses, change (if at all)?

3) How did conducting research and going through each step of legal analysis help you to reach this conclusion? Analyze how you applied critical thinking and legal analytical skills to assist you in this regard. What new research and/or analytical tool or method did you try for the first time this week? What do you think you do well and what would you like to strengthen so that you continue to improve?

4) Collaborate with each other as the week goes on to make all aspects of this Discussion as robust as possible.

7-2 Milestone four: Performance Report

Specifically, the following critical elements must be addressed:

Performance Report: In this section, you will develop recommendations to improve the performance of the organization, basing your recommendations on evidence from your performance assessment.

A. Determine where the organization is in compliance with its organizational mission. Substantiate your findings with evidence from your performance assessment. In other words, where is the organization complying with its stated goals to move the organization toward its mission?

B. Determine where the organization is in noncompliance, or can improve its compliance with the organization’s mission. Substantiate your findings with evidence from your performance assessment. In other words, w here can the organization improve in complying with its stated goals to move the organization towards its mission?

C. Provide specific recommendations to improve the organization’s performance in meeting its goals and mission. Justify your recommendations with evidence from your performance assessment.For example,you might provide recommendations to bring areas of non compliance into compliance with the mission.

D. Explain how these recommendations might be implemented in the organization. Consider the short- and long-term approach to implementing the recommendations. Consider the costs involved in implementing, staffing necessary, or whether or not policies must be created.

Guidelines for Submission: Your paper must be submitted as a 2- to 3-page Microsoft Word document with double spacing, 12-point Times New Roman font, one-inch margins, and at least three sources cited in APA format.

Discuss the advantages and disadvantages of the study’s research design. Provide a discussion on how the study can be moved forward. What other research might these methods apply?

2 articles would be provided one would be qualitative and the other will be quantitative address each article minimum 2 pages per article.

  • Summarize the research design, and discuss the research method(s) used to answer the research question or assess the hypothesis.

After reviewing the PBS Frontline video(https://www.pbs.org/wgbh/frontline/film/real-csi/) do you believe the standards for admissibility of expert testimony, and testimony regarding the results of tests and analyses conducted of physical evidence espoused in the Frye and Daubert decisions are adequate to protect a defendant’s rights?

Be sure to briefly explain the Frye and Daubert standards and support why, or why not, you feel the standards are adequate.

Also, respond to the following questions/issues:

Should jurors be warned of the potential for bias or the potential for analyst error?
Should national standards for comparisons not firmly founded in science, i.e. fingerprints, questioned documents, toolmarks, etc., be established?
Should jurors be instructed to give greater weight to tests and comparisons with greater scientific bases (DNA v. fingerprint comparison)?
Using APA formatting (abstract not necessary) write a two (2) page paper addressing these questions and including other information you feel is relevant to the issues discussed in the film or other sources.
