What if it had not been 2 years since the violation? What if the UK and Spain explicitly objected to it? What if this vessel had incriminating or military fortification on it? What if there was no war at all? Could US seize the vessels?

Complete the following assignment:

The Special Representative of the United Nations Secretary-General has proposed a treaty that has the United States, all European Union states, Ukraine, and Russia as prospective parties. The treaty provides for

  • a year-long cease-fire covering the provinces that Russia has claimed that it has annexed, and fighting between Ukraine and Russia remains intense in those areas;
  • an end to all weapons supplies and other military support from outside actors;
  • all disputes over the treaty and the disputed areas to be adjudicated through the International Court of Justice (ICJ). The United States has withdrawn its acceptance of the “optional clause,” and all the other states have attached reservations to the ICJ Statute that are the same as the French one in the Case of Certain Norwegian Loans.
  • The treaty enters into force with the ratification of all prospective parties.

As Legal Advisor to the US State Department, Secretary Antony Blinken has asked you to identify all relevant developments in which (1) the proposed agreement might never happen and (2) those that would lead the agreement to fall apart after it takes effect.

Using the international legal rules on treaties (and any material covered through IIC1 on the course syllabus) focus on how various changes, events, or decisions affect the legal status of the agreement

–these scenarios (e.g., one side violates the treaty) might be political or legal, but only consider those with possible legal effects on the proposed agreement.

This paper is worth 15% of your final grade.

The paper will be graded according to the following criteria: (1) breadth of rule coverage, (2) accuracy of argumentation, (3) quality of explanation and argumentation, (4) organization, and (5) writing. The first three criteria will be given greater weight than the last two.

  • What if it had not been 2 years since the violation?
  • What if the UK and Spain explicitly objected to it?
  • What if this vessel had incriminating or military fortification on it?
  • What if there was no war at all? Could US seize the vessels?

Explain how 2 vendors (Filevine and Lawyaw) meet the requirements above. How many pages?

Project Management

Problem: The firm currently uses paper files, manual billing and time tracking using Windows with an Access database. They would like to update to use a modern law practice management software solution to reduce manual overhead for their growing practice. The solution will be used by an admin assistant, a paralegal and Ms Civil, the attorney. The new system does not have to run on Windows or Access.
The new acquired law practice management software must track prospective, current, non-current customers and opposing parties.
The new system must also track billable hours for each customer and provide billing invoices. It should provide case management for repeat customers.

Pick three central themes, issues, concepts, demands, and/or action items from the website of your chosen organization and take a photograph representing each of them. Photographs must be taken by you in the world around you. Let me know if you have any barriers to taking photographs and uploading them, and we will come up with an alternative approach. Avoid including faces unless consent is granted (ask me about a consent form). The photographs can be abstract. Once you have taken your photographs, you will write a journal entry about each one, using at least one course reading to develop your thoughts in each entry. #10. Lloyd, an attorney, was appointed guardian of Ernest Parker. Two years later, he was appointed guardian of Virginia Hockenberry. That same year, he agreed to represent David Isaac in the purchase of a plot of real estate from Debra Taylor. On several occasions, Lloyd deposited client settlement checks into his own account. The funds received were therefore commingled with the funds in his personal account. He later used these funds to pay for his student loans, his automobile loan, his insurance, his taxes, his outstanding credit card bills, and his barber. Identify the duties that Lloyd has violated in relation to his principals, Parker, Hockenberry, and Isaac. [See: Office of Disciplinary Counsel v. Lloyd, 643 N.E.2d 1086 (OH).]

#2. Eugene Meade was offered a job by Cedarapids Inc. The job required moving to Eugene, Oregon, where Cedarapids had a facility called the El-Jay Plant. To entice Meade to join the Cedarapids staff, management representatives told him that business was improving, that they believed in the potential of the El-Jay plant, that El-Jay sales were growing, that production at the plant was also increasing, and that there were plans to bring in even greater numbers of new employees. On the basis of these assurances, Meade left his job and moved to Oregon. He also signed an agreement that noted that he was an at-will employee who could be fired at any time. Meade later discovered that all of the statements about the financial health of the El-Jay plant were false. Furthermore, Meade believed that the management had known all along that the statements were false. Meade learned that the El-Jay plant was actually caught in a downward economic spiral and was about to close. When Meade was discharged, he brought a lawsuit against Cedarapids, arguing that he had been defrauded into moving to Oregon. In response, the Cedarapids management team argued that they had no duty to disclose the plan to shut down the Oregon facility. The management team also pointed to the agreement that Meade had signed and concluded that, as an at-will employee, he could not complain about his firing. The trial court agreed and dismissed the case. Meade then filed an appeal. Is there enough evidence of fraud in this case to allow it to go to a jury? Explain. [See: Meade v. Cedarapids, Inc., Case No. 97-35836 (The United States Court of Appeals for the Ninth Circuit).]

#5.Bennerson was employed by the Checker Garage Service Corporation as an auto mechanic. Bennerson filed a claim before the workers’ compensation board. His claim was granted. Cultural lessons play a very significant role in shaping a leader. The cultural differences seen between leaders from the United States and Brazil. Brazilian leaders favor a wide force distance between high-level leaders and different employees to ensure their position and maintain their nationalistic culture of formalization. US leaders will in general move toward cross-cultural management with lower levels of characteristic manliness.
The US leaders embrace a more decentralized, dynamic construction that values the contributions of everyone in the association, including lower-level employees. Brazilian leaders lean toward high vulnerability aversion strategies since Brazil is similarly a high vulnerability evasion country. Brazilian leaders are more mindful of humiliation and outrageous openness in their cross-cultural management strategies.

3: Hofstede’s Cultural Dimensions Theory essentially focuses on the “effects of society’s culture on the values of its members, and how these values relate to behavior.” This is an interesting topic because in another class this week we discuss the relationship of attitudes and behaviors and how they can be understood and used for the betterment of an organization. We are finding that attitudes are a state of being that can affect how one might behave. I see the similarities here, because a society’s culture can have a very big impact on people and put them into a certain state of being that would have them act or behave in certain ways. This theory can help manage the global workforce by analyzing the effects certain cultures have on its people and recognizing its effects. Furthermore, if there are certain positives or negatives that are found, then it would be beneficial to try and adjust these to an optimal state for the good of the global workforce.
