Let’s begin our discussion on recruitment by using a fact pattern from a litigated case. Cone Mills Corporation had several recruiting procedures that gave preferential treatment to applicants who either had family members or friends working for the company. One of these procedures was to give priority to applicants who had family members employed by the company. The other procedure entailed having an unwritten policy that walk-in applicants had to have renewed every 2 weeks. This created a situation where only those walk-in applicants who had friends or family in the company would renew their applications because they would be the only ones informed of the informal rule, which was not presented in any manual or policy. These recruiting procedures were challenged as being discriminatory toward blacks in general, especially black women, because the informal network responsible for recruiting new employees was unavailable to them. The company claimed that the procedures were not designated to be discriminatory, but rather, to create a loyal family atmosphere within the plant (Lea v. Cone Mills Corp., 3001 F. Supp. 97).

Problem Question Scenario: Portfolio B

Jake and Zak are both senior executives within a large financial organisation and, having met through work, became friends and house share. Despite being quite high up in the organisation (or perhaps due to the stress of their positions) they both use drugs for recreational purposes.  Neither of them would consider themselves drug addicts, but both would probably find it hard to give it up completely.

On the evening in question, Zak gets hold of some drugs that are ‘a bit special’ as they are celebrating that Jake has been successful in signing up a big new client and has received much praise and commendation at work. As Zak hands over the little packet to Jake, he tells him that this is ‘the good stuff’ and that he has earned it. Jake self-injects, but later starts to look unwell. Zak thinks that Jake may have had ‘too much’ and wants to get some medical help but Jake is adamant that he doesn’t want Zak to call for an ambulance as, if it comes out at work that they have been taking drugs, they would both lose their jobs. So, Zak looks up information on the internet about drug overdoses and finds a blog that gives helpful advice. Zak follows the directions as to what to do and Jake starts to look and feel better.

Once they are both satisfied that the worst of the situation is over, the friends take a walk around the garden to get some fresh air and then say goodnight and go to their own rooms. However, in the morning, when Zak goes to wake Jake up, he finds him in a comatose state. Zak calls 999 and Jake is taken urgently to hospital, where he is treated for a drugs overdose and placed on life support machinery. Unfortunately, after a long process of medical testing it is found that nothing can be done to save Jake and the life support is withdrawn. It transpires that had Zak sought medical assistance when Jake was first showing symptoms of overdosing, he could have been saved and would not have died.

Advise Zak on the charge he may face in relation to the death of Jake.

For this year’s Actors’ Guild Awards Ceremony, the famous actor Gerald O’Mahoney has declined to attend as he is currently in what he describes as ‘yet another rehab trip’ to hospital in London. He is, however, a keen blogger with hundreds of thousands of followers who like to hear his thoughts on current films and Hollywood gossip. Gerald watches the awards from his room and cannot resist blogging his thoughts as the ceremony unfolds.

As the actor and film star Robert Uppery walks down the red carpet, Gerald blogs: ‘Nice to see Robert looking so fit and tanned. Shame he left all that ‘toothpaste’ under his nose! LOL’

He goes on to write that, ‘Millie Roscovich is looking..err big..has she been at the donuts again? But that would be such a coincidence considering Harvey Goldstein says she’s expecting Gordon Strange’s baby…she’s positively blooming! Pity Gordon’s married to someone else….’.

Towards the end of the evening, as the contenders for Best Picture are announced, Gerald cannot help himself from commenting on the production company that refused to produce his latest script: ‘Amazing that Schlock Pictures don’t have a film in the list! If you look at their latest financial figures they can’t afford their next offering, Titanic 2 – The Return’ to hit an audience iceberg…they’ll be the ones to sink without trace!’

As the evening wears on Gerald becomes more depressed. He decides to tweet about his latest experience coming through arrivals at Heathrow Airport: ‘Had the worst experience coming through Heathrow the other day – such queues! I’ll bring a machine gun next time. That way I can chop that queue down to size!’

With reference to relevant case law and statute, explain the liability Gerald may have:

Cyberstalking, Harassment, and Bullying Legislation

The advent of the Internet and the subsequent proliferation of online social media has given people worldwide new and exciting ways to communicate and connect with family and friends. However, there is the unfortunate reality that the world of social media also draws those whose intents are not to interact in socially desirable or appropriate ways. There have been numerous instances of cyberstalking, cyberbullying, and cyberharassment that have been sensationalized in news programs and televised dramas.

After instances of suicide and even murder, legislative bodies in many nations began to look for possible solutions to curb the problems associated with cyberstalking, cyberharassment, and cyberbullying. The United States and Great Britain appear to be leading the charge in developing legislation designed to put an end to the harmful effects of online antagonism.

For this week’s discussion, analyze current legislation that has been developed in efforts to end cyberstalking, cyberharassment, and cyberbullying. At times, official legislation fails to take into account the harm online crime inflicts on individuals. Select at least one prominent piece of legislation, and examine how it is intended to function to cease an antagonist’s behavior.

Obscenity Statutes

Prior to beginning work on this discussion, read the Heins (2009) and Kinsley (2013) articles.

Technological advancements associated with the Internet and global economics were paralleled by new avenues for marketing pornography along with a variety of obscene materials. No longer do people need to venture forth to visit adult bookstores or sex shops. Availability of the desired commodity is now as easy as accessing one’s computing device. However, as access to sordid material is made decidedly easier, efforts to combat the dissemination of such material also becomes more fervent as pedophiles and human traffickers have turned to the Internet to target children and young people.
