As you have learned, cyber crime is an international issue the implications of which are only beginning to be realized. For this interactive assignment, you will be assigned a country to research and for which to create presentation. Your presentation will provide information about cyber crime in the assigned nation and the threat to the world at large this represents.

Five nations will be examined: Brazil, China, Germany, Russia, and the United Kingdom. See the list below to determine which country you will be assigned for your presentation.

Defenses to Cyber Crime Allegations

Prior to beginning work on this discussion read the Brenner, Carrier, & Henninger (2004), and Hernacki (2012) articles. Review the instructions and research a minimum of one additional scholarly source to support your work.

Traditional notions of due process, legal defense, and fairness apply to cyber crimes just as they apply to any other notion of more traditional criminal allegations. Throughout your readings this week you have learned that there are two fertile areas for a defense to a cyber crime allegation: factual and legal. A factual defense can easily be summed up by the inimitable legal scholar, Mr. Bart Simpson, of the long-running animated television series, The Simpsons. Bart routinely asserts the factual defenses to allegations of wrong doing as, “I didn’t do it; nobody saw me do it; there’s no way they can prove anything.” These are all valid and somewhat comprehensive definitions of a factual defense. A legal defense, on the other hand, deals with the government’s inability to overcome a defense based on the law in areas such as jurisdiction, vagueness of the law(s), double jeopardy, statutes of limitation, etc.

The national effort to tackle the Coronavirus health emergency has resulted in UK ministers being granted some of the broadest legislative powers ever seen in peacetime. The Coronavirus Act 2020 and other Acts of Parliament have been used to greatly restrict the liberty of movement of people. At the same time, Ministers have issued guidance on how its legal rules restricting liberty should be applied. Sometimes this guidance has seemed to increase the level of restrictions beyond those actually set out in law. For example, under the first national lockdown in England and Wales, the law prohibited you leaving your home except for essential purposes.
