Policy Choice Examples:
I. Arrests
Policy: Police should collect data on the race and release records of every person they arrest.
Pros: This will enable departments to track officers who arrest minorities without sufficient cause.
Cons: Police have too much paperwork already and the statistics collected will be meaningless.
II. Plea Bargaining
Policy: Plea bargaining should be abolished.
Pros: It will do away with an informal process subject to abuse because the courts do not review it. It will ensure that all defendants have their day in court.
Cons: Doing away with plea bargaining will clog the courts with cases awaiting trial, resulting in increased court costs.
III. Sentencing
Policy: Federal law should not make first-time drug offenders face mandatory sentences. Judges should be allowed more discretion in sentencing these drug offenders.
Pros: Mandatory-minimum sentences cause first-time offenders, mostly minorities, to go into an already overcrowded prison system.
Cons: Mandatory-minimum sentences are needed to show we are serious in our war on drugs.

This discussion requires some personal reflection. I use this activity in many of my classes because it is important to consider how personal views impact, and often limit, what we learn. Our society offers many opportunities to define ourselves as “conservatives” or “liberals.” While the terminology is inaccurate, most of us know where we fall along this spectrum. Some of us are also very libertarian, an ideology that doesn’t always fit the conservative/liberal dichotomy. We also have personal views and ideologies about crime and justice, similar to other political perspectives, but defined in different ways.
Our initial discussion focuses on the crime control “assembly line” and due process “obstacle course.” Herbert Packer’s theories provide us with another way to categorizes our ideological perspectives. Ideally, we will also reflect on the policy realities of these ideological choices.
Some of us want more efficient justice, and our media and politicians certainly support the “lock ’em up” mentality, while others have serious concerns about the realities of error in an efficient system. Efficiency is great for totalitarian regimes, a reality clearly understood by the framers of the Constitution of the United States.
Wandering Dago, Inc. (WD), operates a food truck in Albany, New York. WD brands itself and the food it sells with language generally viewed as ethnic slurs. Owners Andrea Loguidice and Brandon Snooks, however, view the branding as giving a “nod to their Italian heritage” and “weak-ening the derogatory force of the slur.” Twice, WD applied to participate as a vendor in a summer lunch program in a state-owned plaza. Both times, the New York State Office of General Services (OGS) denied the application because of WD’s branding. WD filed a suit in a federal district court against RoAnn Destito, the commissioner of OGS, contending that the agency had violated WD’s right to free speech.

In the case of Ontario v. Quon, 560 U.S. 746 (2010), a city police department read personal text messages sent and received on a pager that the employer owned and issued to an employee, a police officer.
